Growceanu is an investment platform that offers best-in-class tools and processes to business angels with €40k to €250k early-stage startup investment budget to help them build high-performance portfolios.

The purpose of these general conditions is to define the terms and conditions for the provision and use of the Growceanu Investors platform and the Growceanu.com website.
By using the site and the platform, you acknowledge that you have read these terms and accepted them. Please read these Terms and Conditions carefully before you start using the website.
Any new feature or option that will be added to our website and platform will also be subject to these terms and conditions. You can read the latest version of our terms and conditions on this page. We reserve the right to update, change or replace any part or detail of our terms and conditions by informing you of the changes through the communication channels available on our online platform. It is your responsibility to check this page periodically to verify the changes.

Platform/Application/app refers to Growceanu Investors platform;
Investor - the natural or legal person who invested in/is in the process of investing in one or more start-ups listed with us;
Entrepreneur – the natural person who owns/manages a start-up listed with us;
User - any person who uses the website;
Member - a person who has an account on the Growceanu Investors platform;
Contract - the agreement between Growceanu and an Investor;
Service - features offered by Growceanu to the Investors or Entrepreneurs on the Platform, for a specific period of time, as a result of the contract performed;
Link - a keyword or a website outside Growceanu.com that once launched, will initiate a visit to a new web page.
The Platform and website including, but not limited to the general layout, design, content, characteristics, functionality, all the information, software, displays, images, design, selection, arrangement, text is exclusively owned by Growceanu and protected by patents, intellectual property, property rights laws, trademarks, international copyright, trade secret and shall not be used or duplicated outside the Platform/website. Users/Members have no right, and specifically agree not to do the following with respect to the Platform/website or any part, component or extension of the Platform/website:
To the extent that you provide Growceanu with any comments, suggestions or other feedback regarding the Platform as a whole, as well as other Growceanu products or services (collective, the “Feedback”), you will be deemed to have granted Growceanu an exclusive, royalty-free, fully paid up, perpetual, irrevocable, worldwide ownership rights in the Feedback. Growceanu is under no obligation to implement any Feedback it may receive from users/members.
Growceanu may make changes to its Terms and Conditions from time to time. When these changes are made, Growceanu will make a new copy of the Terms and Conditions available on this page.
You understand and agree that if you use Growceanu after the date on which the Terms and Conditions have changed, Growceanu will treat your use as an acceptance of the updated Terms and Conditions.
In order to become a Member of Growceanu Investors application, you must fill out the information needed in the sign-up section after downloading the application. You must provide your name, a valid email address, a phone number and optionally a profile photo and LinkedIn account link. Please provide accurate information to facilitate the account creation.
These informations can be changed in ‘My profile’ section in the app.
You agree that all the information you provide on the Platform is ruled by Growceanu’s Privacy Policy, and you agree on how and why Growceanu processes your personal data as declared in the Privacy Policy.
If for any reason you wish to deactivate your account, you can contact us at grow@growceanu.com.
It is your responsibility not to disclose your login information. Therefore you are fully responsible for all the actions that occur on your account. You agree not to disclose your personal information, and if you suspect any malicious activity on your account, contact us at dpo@growceanu.com.
Once you set your account you have access to the information about start-ups (amounts raised, valuation, investment interest), you can follow start-ups, you can see events and you can send feedback.
After creation, your account will be in a pending approval status, until a member of the Growceanu team approves your account. If your account is approved you will also have access to start-up owners, start-up documents, detailed information about members/investors, you can see reviews and you will be able to express your interest in investing.
If the start-up raises an 50.000 € interest, Growceanu will initiate the investment process and will request additional information from start-ups and investors in order to conclude the investment.
When using Growceanu application and website and creating an account, you agree to hold harmless and indemnify all of the Growceanu group, agents, representatives, successors and assign against and from all and any claims, causes of action, suits, demands, judgments, actions, proceedings, damages, losses, liabilities, costs and expenses with no limitation and including attorneys’ fees and legal costs, that may come out of the following:
You are not allowed to:
You must not use any automatised program, process or tool (bots, robots, web crawlers, automated scripts, etc.) to extract, harvest, collect or gather content or information from Growceanu application or website or to access the Platform or any network, server or system associated to Growceanu.
You must not use Growceanu application and website in any way that violates any applicable law or these Terms and Conditions.
You acknowledge and consent that by infringing any of our policies your account will be terminated and your rights to use the Platform will be revoked.
Any attempt to gain unauthorised access to the website and any attempt to fraud will be reported to the competent authorities.
You can report any abuse or complain about unlawful use on Growceanu by contacting us at grow@growceanu.com, outlining the abuse or the complaint.
Your use of the Platform/website and any services or items obtained through the Platform/website are at your own risk. The Platform, the website, the content and any services or items obtained through the Platform or website are provided on an "as is'' and "as available" basis, without any warranties of any kind, either express or implied. Neither Growceanu nor any person associated with Growceanu makes any warranty or representation with respect to the completeness, security, reliability, quality, accuracy or availability of the Platform or website.
The foregoing does not affect any warranties which cannot be excluded or limited under applicable law.
In no event will Growceanu, its affiliates or their licensors, service providers, employees, agents, officers or directors be liable for damages or loss of any kind, under any legal theory, arising out of or in connection with your use, or inability to use, the Platform, the website, any platforms/websites linked to ours, any content on our platform/website or such other platforms/websites or any services or items obtained through our Platform/website or such other platforms, including, but not limited to, any loss of revenue, loss of profits, loss of business or anticipated savings, loss of use, loss of goodwill, loss of data, and whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable.
The foregoing does not affect any liability which cannot be excluded or limited under the applicable law.
No waiver of any term or condition set out in these Terms and Conditions shall be deemed a further or continuing waiver of such term or condition, or a waiver of any other term or condition, and any failure to assert a right or provision under these Terms and Conditions shall not constitute a waiver of such right or provision.
If any provision of these Terms and Conditions is held by a court or other tribunal of competent jurisdiction to be invalid, illegal or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms and Conditions will continue in full force and effect.
Occasionally, the information on the Platform/website may contain typographical errors, inaccuracies or omissions that may be associated with service descriptions, prices, promotions, special offers, costs etc. We reserve the right to correct these errors, inaccuracies and omissions, as well as to change or update information.
Although the Platform/website may link to other websites, we are not, directly or indirectly, implying any approval, association, sponsorship, endorsement, or affiliation with any linked website, unless explicitly stated within. We are not responsible for examining or evaluating, and we do not assure the offerings of any businesses or individuals or the content of their websites. We do not assume any responsibility or liability for the actions, products, services, and content of any other third-parties.
You should carefully review the legal statements and other conditions of use of any website which you access through a link from this Platform. Accessing a link to any other off-site websites is at your own risk.
We are not liable or responsible in any way in the event of Force Majeure, respectively any event beyond of our control or of our commercial partners, which prevents us from complying with any obligations under these Terms and Conditions, including, but not limited to denial-of-service attacks, failure by a third-party hosting or utility provider, unforeseen technical issues, strikes, riots, fires and any other natural events, war, hostilities (whether war be declared or not), invasion, act of foreign enemies, mobilisation, requisition, or embargo.
You and Growceanu agree that these Terms and Conditions shall be governed by and construed under the laws of Romania (without regard to the conflict of law’s provisions thereof) and that any dispute between you and Growceanu concerning the Platform or arising out of or related to these Terms and Conditions shall be resolved exclusively in the courts of Romania.
